TERMS AND CONDITIONS
1. Information on rewards and how to claim form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer.
2. Claims are only open to residents of Australia. Employees and their immediate families of the Promoter and its agencies and companies associated with this competition are ineligible. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. The promotion commences on 1st March, 2010 at 5:00am AEDST and concludes for purchases on 31st May, 2010 at close of business.
4. Each purchase of two specially marked Kinder Bueno Surprise Chocolate bars during the promotion period qualifies the purchaser to claim a $5 Movie ticket at a participating Hoyts or AMC Cinema. To claim, the eligible consumer must take their wrappers to www.bueno.com.au/movies and enter the lot number and expiry date of each wrapper. Upon validation of this information, eligible consumers will be required to enter their details including name, phone number, email address and post code. Upon completion of the claim requirements, the consumer will be able to print off a $5 ticket voucher to use at a participating Hoyts or AMC Cinema. The claimant must handover to box office staff both specially marked Kinder Bueno wrappers and the $5 ticket voucher, in order to claim their $5 movie ticket. If the claimant cannot print off their ticket voucher, they can call 1300 325 422 and have the ticket voucher sent to them. Each claim must be submitted separately and in accordance with claim requirements.
5. Eligible consumers can claim their $5 ticket voucher online up until 11.59pm AEST on June 6th, 2010 and use the ticket voucher to redeem their $5 movie ticket at a participating Hoyts or AMC Cinema through to 11.59pm AEST on July 7th 2010. Tickets are not valid at for 3D films nor at Hoyts Directors Suite, Hoyts IMAX, La Premiere, thehalfpipe, Xtremescreen, movie marathons or any other special events (including 3D films, gala screenings and preview screenings). Tickets are subject to availability of session at the time of attendance. A list of participating cinemas is available on www.bueno.com.au/movies. The ticket is non-refundable, cannot be taken as cash and cannot be exchanged or replaced. Any ancillary costs associated with redeeming the ticket are not included. The ticket is subject to terms and conditions specified on the movie ticket and on www.bueno.com.au/movies
6. There is a limit of six $5 Hoyts/AMC Cinema ticket vouchers per household. Each $5 ticket voucher entitles the consumer to attend any traditional screening at any participating Hoyts or AMC cinema in Australia and pay only $5 for their movie ticket during the redemption period, including those movies marked NFT (No Free Ticket). Only one $5 ticket can be used per movie ticket purchased. All $5 ticket vouchers will be valid for redemption at the box office until 11.59pm AEST on July 7th, 2010.
7. If a customer resides more than 45km from a Hoyts Cinema they will be identified by their postcode when entering their details and EDGE LOYALTY will send them a movie ticket voucher that entitles the customer to a movie ticket at the closest cinema to their postcode where movie vouchers are available. The voucher will be subject to the individual cinema terms and conditions and in the most part will not be valid after 5pm on Saturday nights. Customers will be required to pay $5 to obtain this voucher. Customers will need to download a payment form, enter their details on the form, plus payment details, which can be in the form of credit card or cheque, attach two participating Bueno wrappers and send to Locked Bag 6005, Richmond, Victoria, 3121. Upon receipt of the wrappers and clearance of payment the customer will be sent a movie voucher as described above. A limit of six per household applies as per the standard terms and conditions of the promotion. Wrappers must be posted on or before June 13th 2010.
8. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim or reward that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in reward value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) use of a reward.
9. All information gathered within the promotion becomes the property of the Promoter. All claimant information will be entered into a database and the Promoter may use the personal information supplied by claimants for the purpose of conducting and promoting this promotion. Claims are conditional on providing this information. The Promoter may disclose personal information collected from claimants to third parties and other companies associated with this promotion, including but not limited to agents, contractors, service providers and reward suppliers, to enable claimants to participate in this promotion. Claimants can gain access to their personal information by contacting the Promoter's Privacy Officer on 1300 325 422. Personal information claimants provide during the competition may also be used by the Promoter and its associated companies for an indefinite period, unless otherwise specified, for promotional, marketing, publicity, research, profiling and other purposes, including sending electronic messages or telephoning the claimant.
10. If for any reason this promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of Promoter which corrupt or affect the administration security, fairness, integrity, or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the claim process. The Promoter also reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion.
11. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, Internet claims. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or claim to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to a claimant's or any other person's computer related to or resulting from participation or downloading any materials in this competition. Any cost associated with accessing the promotional website is the claimant’s responsibility and is dependent on the Internet service provider used.
12. The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including a claimant’s identity, age and place of residence) and to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
13. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.
14. The Promoter’s decision is final and no correspondence will be entered into.
15. If for any reason a claimant does not redeem the reward by the time stipulated by the Promoter, then the reward will be forfeited.
16. If any reward is unavailable, the Promoter, in its discretion, reserves the right to substitute the reward with a reward to the equal value and/or specification.
17. Claimants consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
